The Will of

CALEB CROMPTON

of Bridlington Quay, Deceased

Dated 09 May 1727

In the Name of Gods Amen.

I Caleb Crompton of Bridlington Key in the County of Yorke , Master Marriner being sicke weake but of perfect minde & memory doe make and ordaine this my last WILL and Testamt in manner following.

First
I Give & Devise unto my mother Anne Crompton during her Naturall Life all those severall Tenemt or dwelling Houses with their appurtenances situate in Bridlington Key now in the occupation of her the said Anne Crompton and of John Coupland & William Coupland and from and after her Decease I Give & Devise all the said Tenemts with appurtenances unto Rebecca my Wife and Jane my Daughter for and dureing the Terme of their two Naturall lives and the life of the longer liver of them two and from and after their two Deceases and the Death of the Survivor of them

I Give and Devicse the same Tenemts until the Heires of the body of any said Daughter Jane lawfully to be begotten and for default of such Issue I Give and Devise the same to the right Heirs of one the said Caleb Crompton for ever

I Give and Devise unto the said
Rebecca my Wife and Jane my Daughter for & during the Terme of their two Naturall Lives and the life of the longer liver of them two, all of my Tenement or dwelling House with Appurtances in Bridlington Key aforesaid now in the occupation of William Dalton and after the death of the Survivor of them I devise the said Tenemt last mentioned with Appurtances unto the Heirs of the body of my said daughter Jane Lawfully to be begotten & for default of such issue to the right Heirs of one the said Caleb Crompton for ever charged & chargeable with payment of forty shillings p ann unto my said mother dureing her Naturall Life by quarterly paymts and to commence from the time of my Decease, [to sheet 2]

And for non payment thereof,
It is my WILL & I doe Give unto my mother or her assignes from time to time power & authority to Enter upon the said Tenemt & to distreyn for the said forty Shillings p ann or so much there of as shall be in arreare & to sell & dispose of such distresse & distresses untill the said Arreares be pd and all costs and Charges that shall happen for non paymt thereof

I Give and Devise unto Thomas Goulton of Bessingby gent Leonard Bower of Bridlington Key Mercht & the said Rebecca my Wife and the survivors of the and the Heirs and assignes of such survivor all that my Tenemt or Dwelling House wherever I now live in Bridlington Key with Appurtances thereunto belonging in trust only and to the intent & purpose that they the said Thomas Goulton, Leonard Bower & the Rebecca my Wife and the survivors & Survivors of them and their heirs & assignes of such Survivor doe & shall with all convenient speed sell & dispose of the said Tenemt with the appurtances to the best bidder and for the best price that can be gotten for the same & the money arising by the sale thereof to be put out at Interest for the Uses herinafter mentioned

I Give & Bequeath unto the said Rebecca my Wife and Jane my Daughter all my Household Goods & Implements of Houshold Plate Linen and all other Utensills goods & Chattels in & about my own Dwelling House in Bridlington Keys aforesaid

I Give & Bequeath unto the said Thomas Goulton, Leonard Bower & Rebecca my Wife and the survivor & Survivors of them all that my Pinke Ship or Vessell called the Happy Retwine with the boat & all the Tackle Furniture & Appurtances to the said Ship or Vessell belonging or in any wise appertaining in Trust only and to the End Intent & purpose that they or they Survivors or Survivors of them doe & shall with all convenient speed sell & dispose of the said Pinke or Vessell with appurtances to the best bidder and for the best price that can be gotten for the same & the money arising thereby to be disposed as hereinafter mentioned.  [to sheet 3]

I Give unto the said Thomas Goulton, Leonard Bower & Rebecca my Wife all the rent & residue of my Personal Estate not above devised to my Wife & Daughter together with such Money as shall become due after my Decease from Mathew Speck by vertue of a contract made betwixt him myself & others Masters of ships in case of any of or Deaths or losse of ships or for or on account of any of my apprentices for the respective Termes they are to serve me, and for their Wages to be by them earned dureing the time of their Apprenticeships all which Sume and Sums of money which the said Thomas Goulton, Leonard Bower & the Rebeccamy Wife shall receive by force & virtue of this my WILL either by the sale of any Tenemt or Dwelling House or by Sale of any said pinke or Vessell or by any other varies & meanes whatsoever my WILL & minde is shall be paid and disposed of in manner following.....

In the first place
I WILL that out of the money soe to be reced by my said Trustees they shall pay & discharge all my just Debts of what nature soever the same are and all my Funerall charges with the Proveing and Registring this my WILL that they shall discharge the Money due upon Mortgage I owe upon some pt of my Tenements above menconed & all Interest for the same and see the said Mortgages discharged at the Registery Office at Beverley, that in the next place they pay or permit the said Rebecca my Wife to retaine out of the Money soe to be received the Sume of Thirty pounds for the better Support & maintenance of herself & my said Daughter and after the payment of all the said Severall Sumes My WILL & minde is the residue & remainder of the said Money as soe to be raised & received by my said Trustees shall be from time to time put out at Interest and the Interest and proceed thereof shall be paid unto the said Rebecca my Wife and the said Jane my daughter untill my said daughter shall attain the age of one & twenty yeares & when she attaines the Age my WILL is that one Moiety or halfe the said Money soe to be reced shall be paid unto the said daughter and in case my said Daughter dye before she come at Age.

It is my WILL that the Interest & proceed of that moyety shall be paid to my Wife for her life and after Her the principall that is the Moiety soe given to my Daughter shall be paid unto my Nephew Caleb Crompton or his Representatives and as to the other moiety of all such Sume & Sumes of Money.  [to sheet 4]

It is my WILL that my Wife shall receive the Interest & proceed thereof dureing her Life and that then in case my daughter be living the principall & Interest shall be paid unto her but in case she be Dead before my Wife then it is my WILL that my Wife shall have Forty Pounds to be disposed of as she thinks fitt and the residue my WILL is shall be paid unto my Nephew Caleb Crompton or his Representative

And it is my WILL and minde that my said Trustees shall not be answerable or Accountable for the Act or Deed of one another but each party for him or herselfe only, nor shall they be Accountable for any losse unlesse by their owne default & I WILL they shall deduct out of Estate all such Costs charges & Expenses as they shall necessarily disburse in ye management of the Trust hereto [reposed?] in them [severally?]

I appoint the said Thomas Goulton, Leonard Bower & Rebecca my Wife joint Execators of my last WILL & Testamt

In Witness whereof I have here unto [set] my hand & seale this Ninth day of May one Thousand seven hundred Twenty seven:

PINKIE - a small sailing ship with a narrow stern, from the Mediterranean. MOIETY - a share of something divided into two parts, normally a half.
